“Hank” is an Of Counsel Partner in Helena, Montana offices of Hattersley Walter PLLP.

Retiring after 32 yrs. with American Stores, then the ninth largest employer in the United States as Executive Vice President and Chief labor Counsel he embarked on a litigation driven practice, serving as a mediator and arbitrator. His practice focusing on pre-trial and judge directed settlement through ADR and the trial process.

In the public sector he served as Chair of the Montana Board of Personnel Appeals, with jurisdiction over its’ Little Wagner Act. Montana currently has over 26,000 employees covered by the Act.

He has served as pro tem judge for the County Cascade, Montana.

He serves on the national panels of the American Arbitration Association for Employment, Commercial, Construction, Labor and ERISA as well as FINRA.

He has been appointed to the national mediation and arbitration by the Asbestos Personal Injury Trust Fund which is managing the $32 billon fund set up by the asbestos producers and users.

He is a member of the Appellate Mediation Board which mediates all appeals to the Montana Supreme Court.

His arbitration decisions are available on request, provided that prior approval has already been given by the parties.
Illustrative of the complexity of cases handled is the his mediated settlement of the likely largest state class action in Montana involving over 45,000 claims and 17 lawyers. He was appointed by Judge Thomas McKittrick, stemming initially from a discovery dispute and the exposure to sanctions  in excess of $12 million.
